Liability Waiver

Assumption of Risk

1. Participation in Outdoor Activities
   Fishing involves outdoor activities that may include inherent risks, such as:

   • Exposure to changing weather conditions.

   • Slippery or uneven surfaces on docks or boats.

   • Use of fishing equipment, including hooks, rods, and tackle.

   • Accidental falls or injuries associated with boating and fishing activities.

2. Participants voluntarily assume all risks associated with these activities.

3. Physical Fitness
   It is the participant's responsibility to ensure they are in appropriate physical condition to engage in fishing and boating activities.

 

Limitation of Liability

 

Farwell Fishing Guide Service, its owners, operators, employees, and affiliates are not liable for:

• Injuries, accidents, illnesses, or death incurred during guided trips.

• Loss or damage to personal property brought on the trip.

• Delays, cancellations, or changes in the schedule due to weather, equipment failure, or other unforeseen circumstances.

To the fullest extent permitted by law, participants release Farwell Fishing Guide Service from any claims or liabilities, including those resulting in death, arising from their guided fishing trip.

 

 

Terms and Conditions

 

1. Definitions

• "Service" refers to guided fishing trips provided by Farwell Fishing Guide Service.

• "Participant" refers to any individual who books or participates in a guided trip.

• "Guide" refers to Captain Kyle Farwell or any other guide representing Farwell Fishing Guide Service.

 

2. Booking and Payments

1. Reservations: All guided trips must be booked in advance through our website or by contacting Captain Kyle Farwell directly.

2. Payment Methods: Payments can be made via:

   • PayPal: @farwellfishing

   • Zelle: 6036677571

   • Cash App: $farwellfishing

   • Venmo: @kylefarwell

3. Deposit: A $50 deposit is required to secure your booking. This deposit is non-refundable.

3. Cancellation and Refund Policy

Cancellations by Client

​

Cancellations made at least 48 hours in advance of the scheduled trip may be rescheduled at no additional cost.

Cancellations by Farwell Fishing Guide Service

​

1. Trips may be rescheduled or canceled due to weather, equipment issues, or other safety concerns.

2. In such cases, clients may choose to:

   • Reschedule the trip, including if they are unable to attend the originally scheduled trip.

 

4. Photo and Media Release

​

1. Consent to Photography
   By participating, clients agree that Farwell Fishing Guide Service may capture photos/videos during trips.

2. Usage
   These may be used for promotional purposes (e.g., social media, website).

3. Opt-Out Option
   Participants can request not to be photographed by notifying the guide prior to the trip.

 

5. Weather Policy

 

Trips will proceed in light rain unless safety is compromised. Severe weather may result in cancellations or delays. Captain Kyle reserves the right to make the final decision for safety.

 

6. Accessibility and Accommodations

1. Inclusivity: Farwell Fishing Guide Service strives to accommodate all participants, including those with mobility challenges.

2. Advance Notice: Please notify us in advance if special accommodations are required.

 

7. Equipment Usage

 

Participants are responsible for using provided gear properly. Lost or intentionally damaged gear may incur replacement costs.

 

8. Prohibited Activities

1. Safety Guidelines

   • No littering in the lake or surrounding areas.

   • Alcohol and illegal substances are strictly prohibited.

   • Non-compliance may result in trip termination.

 

9. Fishing Policy

1. Catch Limits: Fishing must comply with North Carolina state regulations.

2. Captain/Guide’s Role: The guide will assist participants but does not guarantee a catch.

 

10. Children and Family Policy

​​

1. Life Jackets: Children under 13 must wear life jackets at all times.

2. Supervision: Parental supervision is required for minors.

3. Minimum Age: 5+ years old minimum age requirement.

 

11. Health and Safety

​​

1. Hydration and Sun Protection: Participants should bring water, sunscreen, and appropriate clothing.

2. Medical Conditions: Please disclose any relevant medical conditions to the guide before the trip

12. Customer Responsibility Checklist

​​

• Ages 16 and older are required to Bring a valid North Carolina fishing license.

• Wear appropriate clothing and footwear.

• Arrive 15 minutes before the scheduled trip time.

 

13. Dispute Resolution

 

Disputes will be resolved amicably. If necessary, the jurisdiction will be North Carolina. Arbitration may be required before legal proceedings.
